Cheque payments to approved Reimbursement claimants were issued on Monday, July 31st, 2023.  

Timing for issuing settlement benefits to approved Voucher claimants along with a decision on the eligibility of any disputed claims will be forthcoming.

What are these Class Actions about?

The class actions relate to allegations that certain Nissan vehicles have a continuously variable transmission (“CVT”) that is defective, which can lead to poor transmission performance or failure. Nissan denies these allegations. The parties have agreed to the Settlement to avoid the cost and risk of further litigation.

On March 31, 2022 the Court approved the Settlement as being fair, reasonable, and in the best interests of the Settlement Class A copy of the Approval Order is posted here.

Who is included?

There may be more exclusions. For more information, please see the FAQ and the Settlement Agreement.

What benefits can I receive?

Settlement Class Members may be eligible for one or more of the following benefits, provided they meet certain requirements:

(1)    Warranty ExtensionThe settlement provides an extension of the time and mileage limits for powertrain coverage under your vehicle’s applicable New Vehicle Limited Warranty by 24 months or 40,000 kms, whichever occurs first, to the extent it applies to the transmission assembly (including the valve body and torque converter) and Automatic Transmission Control Unit.

(2)    Reimbursement for Replacement of or Repair to Transmission Assembly or ATCU: The settlement provides reimbursement for parts and labour for Qualifying Repairs involving the replacement of or repair to the transmission assembly or ATCU within the time and mileage limits of the warranty extension.

To receive a reimbursement payment, you must have completed and submitted a claim on or before Septemeber 13, 2022, along with appropriate documentation of the repairs for which you are seeking reimbursement.

(3)    Voucher Towards Purchase or Lease of a New Vehicle: The settlement provides for a Voucher in the amount of $1,300 for either a purchase or lease of a single new Nissan or Infiniti vehicle from an authorized Nissan dealer in Canada, if you are a Former owner of Class Vehicles who had 2 or more replacements or repairs to the transmission assembly or ATCU during their ownership experience (as reflected by Nissan Canada Inc. Warranty records).
